These Terms & Conditions (“Terms”) apply to your access and use of Fuelled’s website and any services, memberships, programs, resources, communications, and platforms we provide (together, the “Services”). By accessing our website or purchasing/using our Services, you agree to be bound by these Terms and our Privacy Policy (together, the “Agreement”). If you do not agree, you must not use our Services. Important: Nothing in these Terms excludes or limits your rights under the Australian Consumer Law (ACL), including consumer guarantees that cannot be excluded.

“Fuelled”, “we”, “us”, and “our” refers to Fuelled. Fuelled provides dietitian-led nutrition support, lifestyle and routine guidance, education, digital tools, and membership-based support services (“Fuelled Support”). Fuelled Support is designed to complement existing supports and services and is delivered within the scope of dietetic practice.

Outcomes vary between individuals. We do not guarantee specific results or outcomes. You are responsible for disclosing relevant medical history, injuries, conditions, medications, and changes to your health. You should seek medical clearance before starting any exercise or nutrition program, particularly if you are pregnant, post-natal, managing illness/injury, or under medical supervision. If you experience adverse symptoms, stop and seek medical attention. Fuelled Support is not a substitute for medical diagnosis, treatment, therapy, or emergency care. Fuelled does not provide medical advice.

We will describe the current inclusions at the point of purchase or onboarding. Changes do not imply guaranteed outcomes and are intended to support continuity and quality of service delivery.

Some Fuelled memberships (especially higher-touch and fully tailored services) require a minimum commitment period (“Minimum Term”). The Minimum Term (and what’s included) will be disclosed prior to purchase or in your onboarding agreement. If a Minimum Term applies, you agree to remain a member (and pay all fees due) for the Minimum Term unless required otherwise under ACL or as agreed by Fuelled in writing. This Minimum Term exists to support continuity of service delivery and participant engagement, not quick fixes.

Payments, Billing & Auto-Renewal

Where offered, memberships may auto-renew on a recurring billing schedule (e.g. weekly, fortnightly, monthly). By purchasing a membership, you authorise Fuelled (or its payment processor) to charge your selected payment method on the agreed billing schedule. You are responsible for ensuring your payment details are accurate and up to date. Failed payments may result in paused access until payment is resolved.

If your membership is not subject to a Minimum Term, you may cancel by providing a minimum of 14 days’ notice in accordance with the cancellation instructions provided at the time of purchase or by contacting us. Access to services and billing will continue during the notice period.

If your membership is subject to a Minimum Term, cancellation may only take effect after the Minimum Term ends, and requires a minimum of 14 days’ notice, unless required by law or Fuelled approves an early cancellation in writing at our discretion.
Pausing
We may offer pauses on certain memberships, such as for travel or injury, subject to eligibility and notice. A once-off pause of up to 2 weeks is available to all customers. Pauses are not guaranteed, may be limited in duration, and do not remove Minimum Term obligations unless agreed in writing.

If your membership includes calls/consultations: you are responsible for attending at the scheduled time rescheduling requires reasonable notice (as outlined in your booking confirmation or onboarding terms) repeated no-shows or late cancellations may result in forfeiture of that session, at our discretion

Intellectual Property

All content and resources provided by Fuelled (including nutrition frameworks, educational materials, tools, template, videos, PDFs, branding, and educational content) are owned by Fuelled or licensed to us (“Fuelled Content”). You are granted a personal, non-transferable, revocable license to use Fuelled Content for your own use while you remain an active member. You must not: copy, sell, redistribute, publish, or share Fuelled Content use Fuelled Content to train clients or create competing services reproduce or adapt our materials for commercial use

If you submit content to Fuelled (messages, photos, check-ins, progress updates, testimonials, etc.), you: confirm you have the right to share it, and grant Fuelled permission to use it for service delivery and internal operations. If we wish to use your identifiable content for marketing (e.g. before/after photos, name, face), we will seek consent unless it has been provided separately. Community spaces (if offered) must be respectful and safe. We can remove content or members at our discretion for breaches.

Fuelled may use third-party tools for payments, booking, communication, service delivery, analytics, or community access. We are not responsible for outages, errors, or issues caused by third-party services, but we will take reasonable steps to restore access or offer alternatives where practical.

To the maximum extent permitted by law, and without limiting your rights under the ACL: Fuelled is not liable for any indirect, consequential, incidental, or special losses (including loss of profits, loss of data, or loss of opportunity). Fuelled is not responsible for injury, loss, or damage arising from your failure to follow instructions, disclose health risks, or exercise safely. Our total liability for any claim connected to the Services is limited to the amount you paid to Fuelled in the preceding 3 months (or the minimum amount required by law), unless the ACL requires otherwise. Nothing in these Terms limits liability that cannot be excluded under the ACL. Nothing in these Terms creates a therapeutic, medical, or treatment relationship between you and Fuelled.

If you have a concern, you agree to contact Fuelled first so we can attempt to resolve it promptly and fairly. You must not initiate a payment dispute/chargeback for services already delivered, except where: there is suspected fraud, or required by law, or you have made genuine attempts to resolve the matter with Fuelled and it remains unresolved. We reserve the right to suspend access during unresolved payment disputes.
